Agi3 Privacy Policy
The privacy and security of personal information is very important to Agi3 Ltd. (“Agi3”). It is Agi3’s policy to protect and respect the privacy of personal information in accordance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (Canada). This Privacy Policy explains Agi3’s privacy and security practices with respect to all personal information in the possession and control of Agi3, and may be supplemented by specific policies, procedures, and practices.
Why does Agi3 collect personal information?
Agi3 may collect personal information from individuals (such as from customers, staff, sub-contractors, and suppliers) for the following purposes:
- To provide individuals with requested information, products, and/or services including allowing individuals to participate in interactive features of Agi3’s services when they choose to do so;
- To administer, plan, and manage the relationship with customers;
- To communicate with individuals, including notifying individuals about changes to Agi3 services and products;
- To better understand how Agi3 may improve its products and services, to develop and conduct its business and operations, and for other internal business purposes;
- To provide individuals with information on current and future products and services or other developments with respect to Agi3 and its service partners (in accordance with Canada’s Anti-Spam Legislation – see below);
- To comply with applicable legal and regulatory requirements or to protect Agi3’s legal rights and property;
(collectively, the “Authorized Purposes”).
The type of information that Agi3 may collect from individuals includes, for example, name, email address, address, phone number, cookies and Usage Data (as defined below), and other information which individuals choose to provide in relation to products/services provided by Agi3.
Agi3 may collect personal information for other purposes where it has a legal duty or right to do so or where Agi3 has a good faith belief that it is necessary to protect the property or rights of Agi3.
Agi3 does not collect personal information for any other purposes, unless it has the consent of the individual to whom it relates.
How does Agi3 collect personal information?
Agi3 only collects personal information about an individual with the individual’s knowledge and consent. Generally, this means that Agi3 collects personal information directly from the individual to whom it relates, whether via Agi3’s website, online applications, e-mail, telephone, or in person. Occasionally, Agi3 may collect personal information from third party sources, but only with the knowledge and consent of the individual or where otherwise authorized by law.
Users of Agi3 services should also be aware that anonymous technical information may be collected by Agi3 in relation to such use (“Usage Data”). This Usage Data may include information such as an individual’s computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of the Agi3 website that the individual visited, the time and date of the visit, the time spent on those pages, unique device identifiers and other diagnostic data. When an individual accesses Agi3 services or website with a mobile device, this Usage Data may include information such as the type of mobile device used, the mobile device unique ID, the IP address of the mobile device, the mobile operating system, the type of mobile Internet browser used, unique device identifiers and other diagnostic data. Agi3 uses this anonymous technical information for purposes such as diagnosing problems with Agi3’s servers, improving the operation and content of Agi3’s services and compiling aggregate and statistical information.
Agi3 will not attempt to link or match such anonymous technical information with any personally-identifiable information unless Agi3 has an individual’s consent, Agi3 (or its service providers) have detected or reasonably suspect any unlawful use of Agi3’s services or a security breach, or Agi3 has a legal duty or right to do so.
Agi3 may use “cookies” on its website. “Cookies” are small text files placed on computers that can collect and store a variety of information. Permanent cookies are stored indefinitely on a user’s hard drive unless manually deleted, while temporary cookies are automatically deleted from the user’s browser upon logging out of a website. Web browsers typically allow users to disable permanent and/or temporary cookies. However, if you disable cookies, you may not be access some of Agi3’s services.
Please note that Agi3’s services may contain links to other websites. Agi3 is not responsible for the privacy practices used or followed by other websites. You are encouraged to be aware of when you leave Agi3’s website, and to read the privacy statements of each and every website you may visit that may collect personal information from you.
When does Agi3 use or disclose personal information?
Agi3 only uses or discloses personal information as reasonably required to facilitate the Authorized Purposes listed above.
In some cases, Agi3 may share personal information with third party service providers performing functions on Agi3’s behalf in relation to the Authorized Purposes, including, for example, vendors that process credit card orders, provide us marketing or promotional assistance, or analyze our data.
Agi3 may share personal information with its service partners to facilitate providing individuals with information on current and future products and services or other developments with respect to Agi3 and its service partners. Agi3 will, and will ensure that its service partners will, only contact you for such marketing purposes in accordance with Canada’s Anti-Spam Legislation, which is further discussed below.
Agi3 may choose at any time to expand, sell or simply reorganize its business and/or the services. Agi3 may use or disclose personal information in connection with a refinancing, the reorganization of its business, or a prospective or completed business transaction, including for the purpose of permitting an interested party to conduct the due diligence required in order to determine whether to proceed with a transaction. Agi3 will ensure that appropriate safeguards are in place prior to the use or disclosure of personal information for such purposes, all in accordance with the requirements of applicable privacy laws.
Agi3 does not rent, sell or trade customer lists or other personal information.
Consent – Is there a choice?
Individuals provide their consent to the collection, use, and disclosure of personal information by Agi3 when they provide their information to Agi3 or use its products or services.
Individuals can deny or withdraw their consent to Agi3’s collection, use and disclosure of their personal information at any time upon reasonable notice, subject to any legal or contractual requirements. However, if consent is denied or withdrawn, Agi3 may not be able to provide certain products or services.
Agi3 and its service partners may use personal information to inform individuals of current and/or new products or services or other developments that Agi3 or its affiliates or service partners believe will be of interest to individuals in accordance with applicable laws including Canada’s Anti-Spam Legislation. Such communications may be made by way of telephone, text message, direct messaging, e-mail, fax or regular mail. Individuals provide their consent to Agi3 and its service partners contacting them in this manner when they use Agi3’s products or services. How does Agi3 protect the security of personal information?
Agi3 has in place reasonable policies, procedures and safeguards (including physical, technological and organizational measures) designed to protect the security of personal information under its control.
The protection of personal information is of paramount concern to Agi3, and Agi3 is prepared to take appropriate and timely steps in the event of any incidents involving personal information in accordance with applicable privacy laws.
Agi3 makes every reasonable effort to ensure that personal information is accurate and complete. This may involve requesting further information or updates from individuals. Agi3 relies on individuals to notify Agi3 if there is a change to their personal information that may affect their relationship with Agi3.
Agi3 retains personal information only as long as is reasonable to fulfill the purposes for which the information was collected, or for legal or business purposes.
Does Agi3 provide access to personal information?
Agi3 will provide individuals with access to the personal information Agi3 holds about them in accordance with applicable laws.
Agi3 will correct or amend the personal information in its files where it can be shown that the information is incorrect or incomplete.
Storage and Processing
Agi3 will store the personal information on its internal servers and/or with its service providers.
Agi3’s service providers may store and/or process personal information outside of Canada (including in the United States of America). When information is stored or processed outside of Canada, it may be subject to the laws of and be accessible by legal authorities in such other jurisdictions. Agi3 has taken appropriate technical, organizational, and legal steps to secure this information.
When your information is no longer required for Agi3’s purposes, we have procedures to destroy, delete, erase or convert such information into an anonymous form, in all cases in a way that protects your privacy and in accordance with any applicable retention and destruction legislative or regulatory requirements.
